Hudson River Sloop Clearwater filed a lawsuit Wednesday in state Supreme Court in Albany seeking to overturn or significantly scale back the state-approved subsidy, which is meant to keep the three plants — including the R.E. Ginna Nuclear Generating Station in Wayne County — up and running.
The lawsuit, which also lists Rockland County organic farm Goshen Green Farms as a plaintiff, claims the bailout will create “unreasonable and unjust” electricity rates. It also accuses regulators of not providing enough time for public comment.
Opposing this subsidy will demonstrate to the country that nuclear power is not where our dollars need to be spent,” Manna Jo Greene, Clearwater’s environmental action director, said in a statement. “Many of these nuclear plants are aging, leaky and dangerous.”
Clearwater, a Beacon-based group, was co-founded by the late folk musician and activist Pete Seeger.
The group’s lawsuit is the second challenging New York’s nuclear bailout.
